A man kills his wife. Many people watch him doing so. Yet no one will ever be able to accuse him of murder. Why?

many years ago their was a boating accident and his wife fell off the boat. the authorities accused the man of pushing her off and killing her on purpose.
The man spent a few years in Jail when suddenly his wife turned up alive somewhere back in their hometown in Vermont.
The authorities had no choice but to let the man go since he was in jail for a crime that never happened.
The man flew to vermont, enraged that his wife never came forward to tell the police that she was really alive and her husband was innocent.
The man found her at a local Burger King, started yelling at her. The fight got so big the local television crew showed up along with the police.
The man pulled out a 9mm gun and shot her in the chest.
The police arrested him for brandishing a weapon in public, but since he was already jailed once for murdering her, they couldnt do it again because of the law of "double jeopardy" that says a man cannot be punished for the same crime more then once.

^^Indeed it was. I think the answer is that no one actually saw his face(wearing a mask). They may have seen him but could not identify him.
